I get that on some level scam has to be intentional, but negligent to this degree, promising something clearly impossible, is a scam too.

Thats of course assuming I believe the creators didnt go out to scam people which Im not even sure I do in this case.

Pretty sure thats actually illegal in the US because you are legally obligated to do what makes the board and investors the most money.
